Protection From Domestic Violence

Victims of domestic violence can petition for a restraining order or protective order in the Ohio courts.

A protective order, is most effective in shielding the victim from the violence of family members (including in laws, roommates, etc.) A protective order can be obtained in a matter of hours, and once served on the defendant, the police will immediately escort him (or her) from your home or place of business and prevent him from returning.

A restraining order is less expensive, but it provides notice to the Judge in your case, that the defendant may act in a way to harass you or another family member. The police will defer any action to the Judge in your case, however, the Judge may take any action she deems necessary to protect you.

The benefit of a protective order is that it provides immediate protection backed up by the police. The drawback is that it is somewhat more expensive. A restraining order is less expensive, however, you may have to wait weeks (or longer) until a hearing date, to address your concerns to the Judge.

Whether you obtain a restraining order or a protective order, you protection also depends on your watching out for trouble and calling the police whenever you are in danger. The police will act immediately whenever a law is broken, especially when someone is placed in danger.
